TERMS AND CONDITIONS

1. Who we are

MindTheChart (mindthechart.io, terminal.mindthechart.io, apps and newsletter) is provided by Marco Aurelio Gallazzi, based in Switzerland ("MindTheChart", "we"). Contact: mindthechartinfo@gmail.com.

2. The service

MindTheChart provides an online terminal with news, market data, charts, indicators, reports and newsletters for informational and educational purposes. Content and features may change over time. Data may come from third parties and may be delayed or inaccurate.

3. Account and access

You log in with your email and a one-time code. Your account is personal: you may not share, resell or let others use it. You are responsible for the security of your mailbox. We may suspend or close access in case of abuse, account sharing, scraping or systematic copying of content, or breach of these terms.

4. Subscription, prices and trial

Subscriptions are monthly or yearly at the price shown on the pricing page at the time of purchase (taxes included where applicable).
If a free trial is offered, the subscription starts and is charged automatically when the trial ends, unless you cancel before.
The subscription renews automatically at the end of each period, charging the saved payment method, until you cancel.
Payments are processed by Stripe: we never store your full card details.
We may change prices: changes apply from the next renewal and are communicated in advance.

5. Failed payments

If a payment fails, Stripe retries automatically for a limited period. After 3 days without payment access is suspended and restored as soon as the payment succeeds. If payment does not succeed within the retry period, the subscription is closed.

6. Cancellation and refunds

You can cancel anytime from "Manage subscription": the subscription does not renew and you keep access until the end of the paid period. Unless mandatory law provides otherwise, started periods are not refundable, in whole or in part.

7. EU consumers · right of withdrawal

If you are a consumer resident in the EU you would have a 14-day right of withdrawal. By subscribing you expressly request that the digital service starts immediately and acknowledge that, with immediate access to the content, you lose your right of withdrawal to the extent permitted by law. Statutory warranty rights are not affected.

8. Intellectual property

Texts, reports, charts, indicators, software, brand and design of MindTheChart are protected. Personal use only. Copying, republishing, reselling or distributing them (including mass screenshots or forwarding newsletters) without our written consent is prohibited. Sharing single images crediting MindTheChart is allowed. Third-party trademarks and data belong to their owners.

9. No financial advice

Nothing we publish is financial advice, an investment recommendation, solicitation or offer to buy or sell any financial instrument. See the Disclaimer.

10. Availability and liability

The service is provided "as is". We do our best to keep it available and accurate, but do not guarantee it will be uninterrupted or error-free. To the extent permitted by law, we exclude liability for indirect damages, trading or investment losses and lost profits; in any case our total liability is limited to the amount you paid in the last 12 months. Liability for intent or gross negligence is not affected.

11. Changes

We may update these terms. Material changes are communicated by email or in the terminal and apply from the next renewal; if you do not accept them you can cancel.

12. Governing law

Swiss law applies. Place of jurisdiction is the owner's seat, without prejudice to the mandatory consumer jurisdiction of your country of residence.

PRIVACY POLICY

This policy is provided under the Swiss Federal Act on Data Protection (FADP) and, for users in the European Union, the GDPR (EU 2016/679).

2. Data we process

Account: email, sign-up and last login dates, one-time login codes.
Subscription and payments: plan, status, dates, invoices, billing name and country. Card data is handled only by Stripe; we see at most brand, last 4 digits and expiry.
Usage: sections visited and frequency, settings, watchlists, bookmarks and preferences.
Technical data: IP address, browser and device, server logs, cookies and browser local storage.
Notifications: your device's technical identifier if you enable push notifications.
Communications: emails you send us, newsletter deliveries and unsubscribes.

3. Purposes and legal bases

Providing the terminal, access and subscription (contract).
Payments, invoices, accounting and tax duties (legal obligation).
Sending the newsletter and service communications included in the subscription (contract / legitimate interest; unsubscribe anytime).
Security, preventing abuse and account sharing, improving the service and usage statistics (legitimate interest).
Push notifications (your consent, revocable in device settings).

We do not sell your data or use it for third-party advertising.

4. Recipients

Only providers we need to run the service, bound by data protection agreements: Stripe (payments), Heroku / Salesforce and their data centers (hosting and database), our email provider (login codes and newsletter), Google Analytics (statistics on some pages), Apple, Google, Mozilla push services (notifications), market data and AI providers (content generation only, without your personal data). Authorities where required by law.

5. International transfers

Some providers are outside Switzerland and the EU (mainly in the USA). Transfers rely on adequate safeguards such as standard contractual clauses or the EU/Swiss-US Data Privacy Framework.

6. Retention

Account data: while you have an account and up to 24 months after your subscription ends, then deleted or anonymised.
Invoices and accounting records: 10 years, as required by law.
Technical logs and detailed usage data: up to 12 months.

7. Your rights

You can request access, rectification, erasure, restriction, portability and object to processing based on legitimate interest by writing to mindthechartinfo@gmail.com. We reply within 30 days. You can also lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC) or, in the EU, with your local supervisory authority.

8. Security

We use encrypted connections (HTTPS), passwordless login with one-time codes and protected admin access. No system is 100% secure: we will notify you of any data breach affecting you as required by law.

9. Minors

The service is intended for adults. We do not knowingly collect data from anyone under 18.

We use technical cookies required for the service (login session, language, preferences, security) and browser local storage for settings, watchlists and data cache. On some pages we use Google Analytics for aggregated usage statistics. We do not use advertising cookies. You can delete or block cookies in your browser; without technical cookies you cannot log in.
